Avoiding Clawbacks in ESI Discovery: How to Conduct a Quick and Effective Online Privilege Review

D-M Information Systems, Inc. offers a new MCLE seminar, “Avoiding Clawbacks in ESI Discovery: How to Conduct a Quick and Effective Online Privilege Review,” a one-hour session.

The newly amended Federal Rules of Civil Procedure now permit the prompt return, destruction, or sequestration of inadvertently produced privileged ESI (electronically stored information). While that is good news, attorneys certainly want to avoid producing privileged information in the first place. By conducting an effective document review in advance of production, using readily available technologies and tools and following easily understood best practices, attorneys can safeguard against such disclosures, protecting their clients and themselves from legal and financial danger.

This seminar discusses the changes to the FRCP, offers numerous “Practice Pointers,” and gives practical advice on how to design and use filters to identify privileged documents and create secure, automated privilege logs. Topics include:

I. Clawback Rules under the newly Amended FRCP
II. A Primer on Privilege
III. Basic Steps for Online Privilege Review
IV. Creating a Complete Privilege Log

This seminar is presented by Robert W. Keenan, JD. It is certified for 1 hour of California MCLE credit including 1 hour Ethics.
